Conflicts regarding intellectual property are often resolved through extrajudicial means, such as notifications, where we aim to clearly demonstrate the rights of our clients and seek from the opposing party the cessation of the infringement.
However, when a conflict cannot be resolved amicably, the only alternative is to initiate a highly specialized judicial process.
Judicial litigation in intellectual property matters occurs in two judicial spheres: within the Federal Court for cases involving the nullification of rights granted by INPI (nullification of trademarks, patents, and industrial designs) and within the State Courts for civil and criminal actions aimed at recognizing the infringement, halting the unlawful act, and obtaining the corresponding compensation.
