Industrial Design

An industrial design registration protects the ornamental character of a two-dimensional or three-dimensional object.

Unlike patents, industrial designs do not aim to protect technical or functional aspects but rather the aesthetic form. There is no substantive examination by INPI, so a prior review is recommended. Our services related to industrial designs include:

Searching for industrial designs in design databases in Brazil and abroad, focusing on reviewing third-party portfolios, registrability, and/or freedom to operate. Filing an industrial design registration request and monitoring the application through all stages of processing. Monitoring registered designs, whether our own or those of third parties. Defense in invalidation proceedings. In Brazil, an industrial design registration is valid for up to 25 years and, before its grant, undergoes formal and technical examination, but without evaluation of novelty and originality.
